·  Who must register their business?

All businesses in Utah are required by law to register with the Utah Department of Commerce either as a "DBA" (Doing Business As), corporation, Limited Liability Company or limited partnership. Businesses are also required to obtain a business license from the city or county in which they are located.

Registration is required so that a comprehensive state registry of all business and corporate information is available for public reference. This information is vital to an orderly legal system and marketplace. Without it, the public or other businesses may have no way of knowing the persons with whom they are doing business.

You can register your business either in person or by mail. There is a $20.00 filing fee for a renewable three-year registration for a D.B.A. Businesses that incorporate form a limited liability company or limited partnership must file incorporating or organizing articles with a filing fee of $50.00.

·  Why are municipal business licenses required?

Local licensure ensures that businesses are safe to the public and given the protections under the law to which a licenses business is entitled. A business may be visited or inspected and required to fulfill local zoning, building and parking requirements before receiving a license. This ensures employee and public health, safety and welfare.

·  What is a business license and do I need one?

A business license is the means whereby Ogden City Corporation grants permission to engage in a business activity at a specific location within the City. The definition of business includes every trade, occupation, profession or activity engaged in the object of gain or economic profit, excluding however, the acts of employees rendering service to employers unless otherwise specifically provided.


5 - 1A - 1 definition states: Engaging in business means and includes, but is not limited to, the sale of real or personal property at retail or wholesale, the bartering or trading of property or services, the manufacturing of goods or property, and the rendering of personal services for others for a consideration by persons engaged in any profession, trade, craft, business, occupation or other calling, except the rendering of personal services by an employee to this employer under contract of personal employment.

You can pick up applications at the Customer Service Center on the second floor of the Ogden Municipal Building, 2549 Washington Blvd. Suite 240, Ogden, UT 84401. Hours are Monday through Friday, 8:00 a.m. to 5:00 p.m. The telephone number is 801 629-8962.

·  How long does it take to receive a business license?

Most general business licenses in the City can be issued within 30 days. A general business license is approved by:

·  How much does it cost?

There is a non-refundable $83 base fee for each most commercial license application plus $7 for each full time employee and $3.50 part-time employee. Disproportionate fees vary and are assessed based on the type of business. Business fees are billed annually. For a new business, license fees must be paid at the time of application.

Background checks are required for the following businesses: beer and liquor licenses, taxi cab drivers, dancers, sexually-oriented businesses and sexually-oriented business employees. Background check are provided by the Bureau of Criminal Identification of the State of Utah, 3888 W. 5400 South, Kearns, UT.

·  Can I operate a business from my home?

If your business meets the conditions outlined below it could be approved.


Home Occupation is defined as the use of a portion of a dwelling as an office, studio or work room for occupations which are customarily conducted in the home that are incidental to the primary use as a home or residence, provided additionally, that: (1) the occupation is limited to members of the family who reside on the premises; (2) such occupation shall not require interior or exterior alterations; (3) the occupation shall not include the sale of commodities which are not produced on the premises; and (4) the occupation shall not use any accessory buildings, yard or space outside of the main building not normally associated with residential use. It may include child day care of not more than five (5) children; and five (5) wholesale and / or retail sales of commodities are not permitted directly from the home.
