Obtaining a Liquor License

This information is intended to help you obtain a new City beer/liquor license and obtain Local Consent approval prior to application for a State beer and/or liquor license. Both City and State alcohol beverage licenses are required. In addition, sale of beer and/or liquor is subject to a special (occupational) tax by The Bureau of Alcohol, Tobacco and Firearms of the U.S. Government.

Typically, the beer and/or liquor license issued by the State is preceded by approval and issuance of City business licenses such as Tavern, Private Club and Restaurant with beer and/or Liquor Consumption. Separate licenses and fees are required in addition to a general business license. Wine is included in the definition of "Liquor" in State law.

BEER - Ogden City beer licenses are classed as follows:

CLASS "A" On premise retailer. This license allows the sale of beer in original containers for consumption off the premises only. An example of this type of license would be convenience and grocery stores.

CLASS "B" On premise restaurant. This license entitles the licensee to all the privileges of a "Class A" licensee and permits the sale of beer for consumption with meals. The nature and volume of the principal business must be as a restaurant. Restaurant licensees may also apply for a liquor consumption license which would allow sale of alcohol along with beer.

CLASS "C" On Premise Tavern. This license entitles the licensee to all the privileges of a "Class A" licensee and permits the sale of beer for consumption with or without food. Patronage of "Taverns" is limited to persons who are 21 years of age or older.

CLASS "D" Private Club. This license is issued to State licensed Private Clubs for on premise sale of beer. The license holder must also obtain a liquor consumption license for sale and consumption of liquor with or without food. Patronage of "Private Clubs" is limited to members or guests of members of the Private Club.

CLASS "E" Single Event. This license is issued to civic, fraternal, religious or governmental groups. The license allows the sale of beer in original containers or on draft at temporary (not to exceed 30 days) special events open to the public.

CLASS "F" Recreational. This license allows the sale of beer in original containers or on draft at recreational facilities. This license is issued to bowling alleys, golf courses and similar premises.

LIQUOR
Liquor consumption licenses are required for Private Clubs and Restaurants who sell alcohol as well as beer. A "Single Event Permit" is available through the State of Utah for temporary sales of alcohol.

APPLICATION PROCESS

The following are the steps necessary for applying and gaining approval of a beer or alcohol license. This license entitles the licensee to all the privileges of a "Class A" licensee and permits the sale of beer for consumption with with or without food.

STEP ONE:
Complete City license applications and pay applicable fees.
STEP TWO:
Your application is reviewed by the Ogden City Community Development Department for applicable Zoning and other City requirements.
STEP THREE:
The application is referred to City agencies for recommendation.
STEP FOUR:
The recommendations are compiled and forwarded to the Mayor or his designee for consideration.
STEP FIVE:
The Mayor or his designee approves or denies the City License and if approved, authorizes their issuance. Assuming the license is approved, the local consent form is also signed. Copies of the City license and the local consent form become part of your application to the Utah Department of Alcoholic Beverage Control.

NOTE: Please keep in mind the processing time necessary to complete the review and approval phases of the City application to avoid unnecessary conflicts. You should allow a minimum of 21 days to gain approval of the City license and signing of the local consent form. State licenses are normally approved by the State Liquor Commission on the fourth Friday of each month and applications and fees should be filed prior to the 10th of any month to be considered at that month's meeting.
