Selection of Developer and Professional Services

List of properties available for development in Ogden:
- 2524 Wall Avenue:
- Size of Property: Development of 0.97 acres of property.
- City Vision: Create a townhome and multi-family development that would further the goals established in the MAKE Ogden Downtown Master Plan.
- 2300 Quincey Avenue:
- Size of Property: Development of 1.85 acres of property.
- City Vision: Develop a seven-lot infill subdivision of high-quality single-family homes in accordance with the East Central Community Plan.
- Size of Property: Development of 1.85 acres of property.
- Capital Square (2459 Quincy Ave):
- Size of Property: Development of 2 acres of property.
- City Vision: Develop a 176-unit podium-parked multi-family residential apartment building in accordance with the Capital Square Concept Development Master Plan.
- Ogden River Redevelopment Project Area:
- Size of Property: Development of 4.45 acres of property.
- City Vision: Develop multi-family housing within the Ogden River Redevelopment Area in accordance with the Ogden Bend Redevelopment Master Plan.
Purpose
The purpose of this policy is to ensure that developer and development-related professional services (e.g., appraisal, architectural, brokerage, and environmental services, etc.) used to complete Agency projects in existing or future project areas are identified and selected in a fair and equitable manner and in the best interest of the Agency, Ogden City, and other partners.
Policy
It is the policy of the Ogden City Redevelopment Agency to select development partners and development-related professional services in a fair and equitable manner. The policy applies to projects where specific Agency incentives will be used to complete the project. Consideration shall be given to the varied and unique nature of each project and the Agency’s interest in ensuring that the project is completed in a way that maximizes the benefits to the Agency, Ogden City, and other partners.
Database of Potential Developers and Development-Related Service Providers
The executive director, or his appointee, shall establish a database of parties interested in providing development services for the Agency. The database shall include the following information:
For developers:
- Name of company
- State of incorporation
- Location of the primary office
- Names of principals and/or owners of the company
- Number of employees
- Development expertise or primary product the company is interested in developing (e.g., single family, multi-family, mixed use, commercial, etc.)
- General financial capabilities of the company (e.g., projects up to $XM in value)
- Other information deemed appropriate by the executive director
For development-related services:
- Name of company
- State of incorporation
- Location of the primary office
- Names of principals and/or owners of the company
- Number of employees
- Development-related expertise (e.g., appraisal, architectural, brokerage, and environmental services, etc.)
Selection of Potential Developers or Professional Services Provider Process
The executive director shall select developers or professional service providers from the established database through one of the following processes:
Public Solicitation – Project Property Owned by the Agency
- Formal Solicitation Process. Administrative staff shall issue a Request for Proposal (RFP), Request for Professional Qualifications (RFPQ), or Request for Bids (RFB) in accordance with Ogden Municipal Code §4-2A et. seq., seeking proposals or services required for development of the project area. The RFP, RFPQ, or RFB should clearly outline the scope, expectations, and desired outcome for the project.
- Waiver by Executive Director- Justification. Public solicitation is the preferred process for developer and professional services provider selection. However, if the executive director determines that a formal solicitation process is not in the best interest of the Agency, the executive director may waive this process with the justification specified in writing for a specific project. The waiver and written justification shall be signed by the executive director and filed with the Board office within thirty (30) days of proceeding with a different selection process.
- Unsuccessful Public Solicitation. If, after seeking a developer or professional services provider through the public solicitation process as established in Ogden Municipal Code §4-2A et. seq. a capable and competent developer is not identified, then the agency staff may select a developer using a different process.
- Developer Selection Notice. If the executive director enters into an Exclusive Negotiations Agreement (ENA) with a selected developer, the executive director shall provide a copy of the ENA to the Board within thirty (30) days of execution.
Sole Source/Direct Negotiation
- Potential Developers or Professional Service Providers Identified. Agency staff shall review the list of developers and professional services providers in the database and select those that most closely align with the type of project or services envisioned or needed by the Agency.
- Informal Interviews. Agency staff shall meet with the identified developers or professional services providers and select the developer or provider whose experience, expertise, and financial capabilities most align with the scope of the project.
- Notice to the Board. If the executive director enters into an Exclusive Negotiations Agreement (ENA) with a selected developer, the executive director shall provide a copy of the ENA to the Board within thirty (30) days of execution.
Unsolicited Proposal
- Project and Developer Evaluation. The executive director shall review unsolicited proposals to determine if the proposal is in the best interest of the Agency, taking into consideration the type and quality of the project or service, the capabilities and experience of the developer or provider, and any potential incentives or expenses needed to guarantee the success of the project.
- Notice to the Board. If the executive director enters into an Exclusive Negotiations Agreement (ENA) with a selected developer, the executive director shall provide a copy of the ENA to the Board within thirty (30) days of execution.
